1. About these terms
These Terms apply to services provided by Mandi Paulene Smith, an individual sole trader trading as Luna Media, ABN 37 312 670 505 ("Luna Media", "we", "us" or "our"), in addition to any project-specific terms set out in a proposal, scope of work or order confirmation. Contact: info@lunamedia.au.
Where a proposal, scope of work or order contains terms that differ from these General Terms, the project-specific document will apply to the extent of the inconsistency.
2. Scope
Each engagement has a defined scope. Larger project details, including scope, payment schedule, delivery timing, revisions, approvals, client delays, third-party costs, hosting, domains, subscriptions, launch approval, maintenance, cancellation, portfolio usage and intellectual property, are set out in the project-specific proposal, scope of work or order confirmation. Work outside the agreed scope may be quoted separately.
3. Fees and payment
All prices are in Australian dollars and include GST. Invoices are payable on the terms stated in the relevant proposal or order.
4. Client responsibilities
Timely delivery depends on the client providing requested information, feedback and approvals within reasonable timeframes.
5. Intellectual property
On full payment, the client receives the agreed deliverables for their intended business use. Luna retains rights to underlying methods, tools and templates.
6. Confidentiality
Both parties will treat non-public information shared during an engagement as confidential.
7. Outcomes
Luna's work is strategic and qualitative in nature. We do not guarantee specific revenue, enquiry or ranking outcomes.
8. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot be excluded, restricted or modified by law. To the maximum extent permitted by law, our total liability for any engagement is limited to the fees paid for that engagement.
9. Governing law
These terms are governed by the laws of New South Wales, Australia.
